AskPro Membership Terms and Conditions

AskPro connects eligible nonprofit and community organisations with individuals who volunteer their professional knowledge, skills and experience. AskPro may also connect organisations with student-led projects, university partners, corporate partners and other forms of support.

AskPro facilitates introductions, helps develop and manage briefs, and supports participation. Unless AskPro expressly agrees otherwise in writing, AskPro does not itself provide the professional advice or project work delivered by a volunteer, student, university, corporate partner or other participant.

You must be at least 18 years old to create an individual account. An organisation account must be created and managed by an authorised representative.

You agree to:

• provide information that is accurate, current and not misleading;
• keep your login details secure and tell us promptly if you suspect unauthorised access;
• update your account information when it changes; and
• use AskPro only for lawful, genuine and community-benefit purposes.

You are responsible for activity undertaken through your account. You must not impersonate another person or organisation, create a false profile, or use AskPro to send spam, solicit unrelated business or engage in unlawful, discriminatory, abusive or unsafe conduct.

Creating an account and participating as a nonprofit member or individual volunteer is free unless we clearly agree otherwise with you in writing before a paid service is provided.

You are responsible for your own incidental costs, including internet access, travel or third-party products or services you choose to use. A volunteer must not charge a nonprofit member for support arranged through AskPro unless the nonprofit, the volunteer and AskPro have agreed to this in writing beforehand.

AskPro will use reasonable efforts to understand requests and identify suitable support. However, the availability of volunteers and other participants depends on their skills, interests, capacity and timing.

AskPro does not guarantee that:

• every request will be accepted or matched;
• suitable expertise will be available for every situation;
• a match will occur within a particular timeframe;
• a participant will complete an activity; or
• any advice, recommendation, introduction or project will achieve a particular result.

AskPro may decline, pause, re-scope or close a request where it is unsuitable, outside the available expertise, unsafe, unlawful, incomplete, beyond the reasonable scope of a volunteer engagement, or inconsistent with AskPro’s purpose.

Support provided through AskPro is offered voluntarily and in good faith. It is general in nature and is based on the information made available to the participant at the time.

Unless expressly agreed in a separate written engagement, participation through AskPro does not create a lawyer–client, accountant–client, financial adviser–client, health practitioner–patient or other regulated professional relationship. AskPro support is not a substitute for advice tailored to all of an organisation’s circumstances from an appropriately qualified and insured professional.

Nonprofit members remain responsible for:

• assessing whether advice or project work is appropriate for their circumstances;
• checking important facts, assumptions and recommendations;
• obtaining legal, financial, taxation, medical, safety, employment or other specialist advice where required;
• making their own decisions; and
• the consequences of implementing, or deciding not to implement, any suggestion or deliverable.

By submitting a request or participating in an activity, you acknowledge these limitations.

Individual volunteers agree to:

• describe their experience, qualifications and availability honestly;
• accept only requests they reasonably believe they are competent to assist with;
• disclose any actual or potential conflict of interest promptly;
• act respectfully, professionally, safely and in good faith;
• comply with applicable laws and any professional obligations that apply to them;
• make clear when a matter requires formal or specialist professional advice;
• not claim authority to bind AskPro or a nonprofit member;
• not use an engagement primarily to sell products or paid services; and
• promptly tell AskPro if they cannot continue or complete an agreed activity.

AskPro may review profile information and facilitate matches, but does not warrant or guarantee a volunteer’s qualifications, suitability, identity, availability or performance. Nonprofit members should undertake any checks reasonably required for the nature and risk of the proposed activity.

Nonprofit members agree to:

• provide an accurate and sufficiently complete description of their organisation, needs and intended outcomes;
• nominate an authorised contact who can respond and make decisions;
• provide timely access to information reasonably needed for the activity;
• treat volunteers, students and other participants respectfully;
• not request work that is unlawful, unsafe, misleading or beyond the agreed scope;
• disclose material risks, restrictions, conflicts and deadlines; and
• review and approve decisions and deliverables before relying on or implementing them.

Unless specifically requested through a secure process, members must not place sensitive personal information, health information, passwords, payment details or confidential client records in an open request or public profile.

Participants must keep confidential information received through an AskPro activity confidential and use it only for that activity. This obligation does not apply to information that is already public, was lawfully known without restriction, is independently developed, or must be disclosed by law.

Before sharing commercially sensitive, personal or highly confidential information, participants should agree on any additional confidentiality arrangements required. AskPro does not guarantee that every interaction will be confidential merely because it was arranged through the platform.

Each participant retains ownership of intellectual property they owned before an AskPro activity.

Unless the participants agree otherwise in writing, a volunteer retains ownership of original materials they create, but grants the nonprofit member a perpetual, worldwide, royalty-free, non-exclusive licence to use, copy and adapt those materials for the nonprofit’s internal operations and community purposes.

Participants must not provide material they do not have the right to share or use. Any different ownership, commercialisation or licensing arrangement should be agreed in writing before substantial project work begins.

By creating an account, you consent to AskPro publishing the profile information you nominate for publication, including your or your organisation’s name, logo or profile image, location, areas of expertise, areas of activity and a description of how you participate in AskPro. AskPro may display this information on its website and in AskPro social media and communications to promote the service and its community impact.

AskPro will seek additional permission before publishing confidential project details, a substantive case study, a testimonial attributed to you, or identifiable photographs or video that were not supplied by you for publication.

You confirm that you have authority to provide any name, logo, image, testimonial or other material you submit and to allow AskPro to use it for these purposes.

You may ask AskPro to stop future promotional use of your profile, name, logo or image by contacting support@askpro.com.au. We will action reasonable requests within a reasonable period. Withdrawal does not require AskPro to recall material already printed or remove historical posts, reports or records where removal is impractical or the material must be retained by law, but we will consider reasonable removal requests in good faith.

AskPro handles personal information in accordance with its Privacy Policy, available through the AskPro website. You agree that AskPro may contact you about your account, requests, matches, activities, service updates, feedback and matters reasonably connected with your participation.

Marketing communications will include a way to unsubscribe where required by law. Unsubscribing from marketing does not prevent AskPro from sending necessary service or account messages.

Participation does not create an employment, agency, partnership or joint venture relationship between AskPro and any member, volunteer or other participant. Volunteers control whether they accept an opportunity and provide their time without expectation of payment, unless a separate written arrangement states otherwise.

AskPro does not represent that any participant holds particular insurance. Each participant is responsible for considering whether its own professional indemnity, public liability, cyber, volunteer or other insurance is appropriate.

To the maximum extent permitted by law, AskPro and its directors, officers, employees, contractors, partners and volunteers are not liable for loss, damage, cost or claim arising from or connected with:

• advice, recommendations, information or project work provided through AskPro;
• a decision made or action taken in reliance on that support;
• the acts, omissions, availability, suitability or conduct of another participant;
• a match not being made or an activity being delayed, changed or discontinued; or
• information supplied by a member or other participant being inaccurate or incomplete.

Where liability cannot lawfully be excluded, it is limited to the extent permitted by law. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.

You acknowledge that participation involves judgment and that outcomes cannot be guaranteed. You accept responsibility for deciding whether and how to rely on support received through AskPro.

You may close your account at any time by contacting support@askpro.com.au.

AskPro may suspend or close an account, remove content, cancel a request or end participation where we reasonably believe that these Terms have been breached, information is false or misleading, conduct creates legal, safety or reputational risk, or continued participation is inconsistent with AskPro’s purpose.

Where appropriate, we will give reasonable notice and an opportunity to respond. We may act immediately where necessary to protect a person, an organisation, AskPro or the public.

Clauses concerning confidentiality, intellectual property, publicity already undertaken, liability, disputes and any accrued rights continue after an account is closed.

AskPro may update these Terms from time to time. If a change materially affects members’ rights or obligations, we will provide reasonable notice through the website, account or email. Continued use after the change takes effect constitutes acceptance of the updated Terms. If you do not agree, you may close your account.

If you have a concern about AskPro or another participant, please contact support@askpro.com.au. We will try to resolve the matter promptly and fairly. Nothing in this clause prevents a person from exercising a legal right or contacting an appropriate regulator or authority.

These Terms are governed by the laws of Western Australia. The parties submit to the courts of Western Australia and any courts entitled to hear appeals from them.
